US Judge Mandates Release of Kilmar Abrego Garcia from Immigration Custody

A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment is without legal authority.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.

The situation originates in a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an mistake. Following his return to the United States to face human smuggling allegations, he was held in federal detention.

In her decision, the judge noted that the authorities does not have a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."

Context of the Case

The legal challenge involve conflicting assertions. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.

He has also entered a not guilty plea to the smuggling counts, which are part of a separate trial in Tennessee.

Terms of Release

The court, who was hearing his petition to removal in a Maryland district court, determined that he must now comply with the terms of his bond from custody in Tennessee. This order shifts his monitoring to the jurisdiction handling his criminal case.
